In terms of the new regulation there is a new field that needs to be completed when advising the Company of an insolvency appointment. The field is title “Appointed By”.

In terms of the new regulation there is a new field that needs to be completed when advising the Company of an insolvency appointment. The field is title “Appointed By”.

There is some confusion amongst members as to what data should be entered into this field.

RITANZ has checked this with the Companies Office and they have advised as follows:

The ‘’Appointed by” field in the notice of appointment must be completed with the information who made the appointment and, if the insolvency practitioner was appointed by the court, who applied to the court for the appointment.

For example, for an appointment of a liquidator – section 241 of the Companies Act 1993 lists who a liquidator may be appointed by.

Also, we have received an important message from IRD for our insolvency practitioners to deal with specific documents sent to Inland Revenue as a creditor in liquidation and receivership appointments:

Inland Revenue has created the following email address to enable you to submit your notification, interim and final reports electronically.
 
Insolvency.notification@ird.govt.nz
 
We ask that you use the following naming process in the subject headers

  • "Notification of ...." for any new liquidation or receivership appointments
  • "Interim Report" for your 6 monthly or other interim reports
  • "Final Report" for any reports advising that you have completed your insolvency activities.

 
The email address will be overseen by people who deal with insolvency work but this is not an alternative process for non insolvency reports.
