Changes to the retentions regime: the proposed new legal requirements and practical implications

The Government has recently proposed some significant changes to the retentions regime, intended to provide further protections in a construction insolvency for contractors and sub-contractors who are owed retentions.   But do the proposed changes adequately fill the gaps in the current regime?  Or will they create new issues? 

In this seminar, Rachel Pinny and Adele Hicks will:

• outline the current retentions regime;
• explain the Government’s proposed amendments to the retentions regime;
• discuss whether those proposed amendments address the issues identified with the current regime; and
• outline some of the practical implications of the proposed amendments.

Presenters:

Rachel Pinny

Rachel Pinny is an experienced litigator with almost 20 years’ experience in general commercial litigation and insolvency.  She has acted for insolvency practitioners in some of New Zealand’s most complex insolvencies including Pike River Coal receivership, Ross Asset Management and the Ebert Construction receivership (retention fund). She is a member of the RITANZ Board.

Adele Hicks

Adele Hicks is a licensed insolvency practitioner and a Director in Grant Thornton’s Financial Advisory Services team. She has 10 years’ insolvency experience in New Zealand, British Virgin Islands and the Channel Islands. She has recently worked on the receivership of Drymix NZ Limited and its related entities and the liquidation of Jonesy Construction.
