Topic: Insolvency and Trusts – a refresher on the principles and a review of some recent cases
The preferred form of creditor protection or debtor avoidance in New Zealand is the humble trust. Trusts have also become a common vehicle through which trade is conducted.
This seminar will provide a refresher on the principles that lawyers and insolvency practitioners who are dealing with insolvent trusts need to be aware of.
We will cover:
the relevant changes to the law arising from the Trusts Act 2019 including creditors’ rights with respect to the trustee’s indemnity ;
insolvency of trustees and distribution of indemnity proceeds;
some recent cases which might provide alternative avenues for recovering against the assets of the trust or associated individuals.

Mike Whale
Mike is a Director at TWA Legal Limited. He has extensive experience across corporate, commercial, banking, securities, restructuring and insolvency law. Jennifer Tunna

Kerry Puddle
Kerry has joined TWA Legal Limited this month as Special Counsel, having previously worked with all of the TWA directors. Kerry is an experienced commercial litigator with an interest in and experience dealing with various legal issues relating to insolvency and trusts.
