Matt Kersey and Emmeline Rushbrook will consider recent cases and developments broadly falling into the duties/conduct/culture arena, including:

• Reckless trading: Mainzeal
• Duties to report conduct under existing law and the Insolvency Practitioners Bill
• The Hayne Commission: potential implications for NZ lending practices & an update on related NZ

Matt Kersey leads Russell McVeagh’s Restructuring and Insolvency team. He is a member of the RITANZ Board and has been specialising in restructuring and insolvency for over 20 years.
Emmeline Rushbrook is a partner at Russell McVeagh whose speciality areas include financial services dispute resolution and regulatory compliance and enforcement. She regularly advises clients on compliance with New Zealand financial services laws, including assisting on conduct, culture, governance, remediation and law reform activities. During the last year Emmeline has been on secondment as Westpac’s Acting Head of Regulatory Affairs & Regulatory Investigations. Emmeline is a RITANZ member and a member of the Wellington chapter of WIRI.
